Municipal Courts are the most frequently used courts in New Jersey. If you have been to court at all, most likely it has been to municipal court.  Every municipality has a municipal court. Each local municipal court hears a wide variety of cases, including traffic tickets, motor vehicle offenses, minor criminal offenses like trespassing, simple assault, theft and low level alcohol and drug charges, etc. 


From my experience, most people are uncertain and nervous when they go to Municipal Court. Some are intimidated by the formal nature of the proceedings. At Hanlon Niemann, our attorneys have handled municipal court cases for over 30 years. We know that the process can be complex, confusing, and frightening. Municipal Courts differ from other civil, criminal, and family courts of our state. A Municipal Court is governed under a specific set of judicial rules and procedures established by the New Jersey Supreme Court which are applicable to this court only. A Municipal Court judge can order jail, fines, community service, and other sentences such as a license suspension and surcharges, which not only impact you financially, but can possibly impact your present and future educational and occupational livelihood as well.


Municipal Courts do not have juries. Instead, your case is presided over by a judge.  The judge alone makes the decision for or against your innocence or guilt and sets your punishment. A municipal court judge has the authority to impose a six month incarceration in the county jail upon conviction.
